Data protection notice for Plan participants and beneficiaries

Introduction

This Data Privacy Notice is provided by Cummins to its Pension Plan participants and their beneficiaries, in connection with the plans that Cummins offers to its employees. The Notice is intended to inform you about how Cummins collects and processes personal data in connection with that Plan, and about your data privacy rights in relation to the data that is collected and held about you.

Data Collection and Use

The personal data that Cummins collects and processes from you in relation to its Pension Plan is limited to that which is relevant and/or required enrolling you in the Plan and administering it. Generally, the data elements that are: your full name, job title, WWID, work email, hire date, employee type (e.g., full or part-time), business address and phone number, home address, business unit, and location, Social Security or ID number, birth date, expected retirement date (if applicable in your country); and beneficiary information (if applicable). The data also includes your salary, the amount deducted for pension purposes, and any contributions by Cummins to the Plan. With the exception of beneficiary information, virtually all of this information is already collected from you in relation to your employment with the Company.

In principle, no sensitive personal data (such as that relating to race, ethnicity, trade union or political affiliation, health or sex life) is collected or processed by Cummins in relation to your Pension Plan. However, depending upon the laws and requirements of your country, a small amount of that information might be included in countries where the pension benefits are adjusted for the number of dependants. Cummins takes steps to collect and process only that data which is necessary and relevant to the processing requirement, and not any additional information.

The information that we collect is used to establish and maintain your pension benefits, facilitate pension payouts to you upon retirement, and comply with our legal and administrative obligations. The personal data is not used for unrelated purposes.

Access and Sharing

Cummins limits access to the personal data collected in relation to the Pension Plan within our organisation to individuals whose job responsibilities require such access. We also share that data with third parties who assist us in administering the Pension Plan and making payments to you. The third parties are required to provide written assurances that they will uphold an equivalent level of protection for your data, and comply with applicable data protection law. Cummins does not permit those third parties or anyone else assisting them to use your data for a purpose unrelated to the Pension Plan.

Data Security

Cummins has put in place technical and organisational safeguards that are consistent with its legal obligations and designed to protect your data from loss, misuse, alternation, destruction or authorised access. Those safeguards are updated as the legal requirements and security threats evolve, in order to best ensure that your data continues to be appropriately safeguarded.

Data Transfers

Because Cummins and its Pension Plan administrator are global organisations, some of your personal data will be transferred, processed or stored outside of your country of residence. While the data protection laws and requirements in other countries do not always offer the same level of protection as those in the European Economic Area, Cummins nevertheless takes steps to ensure that your personal data is protected in a manner consistent with the privacy laws of your country and that applicable data transfer requirements are appropriately fulfilled. Among other things, Cummins is certified to the EU-US Privacy Shield framework for transfers of personal data to the United States (where the Company is headquartered), and also relies on the EU Standard Contractual Clauses or similar arrangements for transfers of EU personal data to other regions. The Company has also put in place an intra-company data transfer agreement that is aligned with the EU Standard Contractual Clauses.

Individual Rights

You have the right to contact the Pension Plan to ask questions about your data, or to request access, amendment, correction or withdrawal from the Plan. You also have the right to object to the processing of your data if you believe it was collected in violation of the data protection laws. The Pension Plan upholds those rights in a manner consistent with applicable laws and regulator expectations. However, if you are unsatisfied with the outcome of your request to the Pension Plan or believe that your data has been mismanaged, you also have the right to file a claim with the relevant EU supervisory authorities.

Data Retention

Cummins retains personal data of its Pension Plan participants and their beneficiaries in accordance with business and legal requirements. Thereafter, the data is securely destroyed.

Accuracy of the Data

Cummins takes steps to ensure that the information that we collect, process and hold about our Pension Plan participants and their beneficiaries is accurate and complete. We ask that you notify us promptly should any of your information change (e.g., address, contact details, beneficiaries).
